Terms of use
The rules for using WeFoundCare’s directory, care quiz, guides and advisor service. Please read them, especially the sections on disclaimers and disputes.
Draft for attorney review. This is placeholder text written for layout and structure. It has not been reviewed by a lawyer and is not in effect. Replace it with attorney-approved language before launch.
These terms are an agreement between you and WeFoundCare. By using wefoundcare.com or our advisor service, you accept them. If you don’t agree, please don’t use the Site.
01Agreement to these terms
These terms, together with our privacy policy, govern your use of the Site and services. Some features may have additional terms, which we will show you before you use them. If those terms conflict with these, the feature-specific terms apply to that feature.
Important: disputes
The arbitration section below asks you to resolve most disputes through individual arbitration rather than in court, and to give up class actions. Please read it carefully.
02Changes to these terms
We may update these terms. We will post the new version here with a new date. Continuing to use the Site after a change means you accept it.
03Who can use the Site
You must be at least 18 and able to enter a binding agreement. If you use the Site for an organization, you confirm you have authority to accept these terms for it.
04Our services
WeFoundCare provides a directory of senior care providers built from public records (state licensing agencies, CMS and HUD), a care quiz, educational guides, and free conversations with local advisors.
Listings come from public records
We work to keep listings accurate, but public records can be incomplete or out of date. Always confirm licensing, services and availability directly with the provider and the licensing agency.
Responsibility for care
Providers listed on the Site are independent. They, not WeFoundCare, are responsible for the care and services they deliver.
Availability and decisions
Inclusion in the directory or a quiz suggestion doesn’t mean a provider has space, accepts a particular payment source, or is right for you. Decisions about care are yours.
05No endorsement; not a broker
Listing a provider is not an endorsement, rating or guarantee. WeFoundCare is not a licensed placement agency, health care provider, insurance broker or legal advisor, unless and where a state requires otherwise and we have said so.
06No professional advice
Guides, quiz results and advisor conversations are general information. They are not medical, legal or financial advice. Talk to a qualified professional about your situation.
07Privacy and consent to contact
When you give us your phone number or email and ask for help, you agree that we may contact you about senior care options by phone, text or email. Message and data rates may apply. You can stop at any time; consent is not a condition of using the Site.
08Recorded calls
Calls may be recorded for quality and training. We will tell you when a call is recorded.
09Automated calls and texts
If you agree, we may use automated technology to call or text the number you provide about your request. Reply STOP to texts to opt out.
10Using the Site
We give you a personal, limited, non-transferable license to use the Site for its intended purpose. You may not copy, scrape, resell or create derivative databases from the directory without written permission.
11No unauthorized access
- Don’t try to break into, overload or disrupt the Site.
- Don’t use bots or scrapers except search engines that follow our robots.txt.
- Don’t submit false information, impersonate anyone, or submit someone’s details without permission.
12Intellectual property
The Site’s design, text, graphics, logos and the compiled directory are owned by WeFoundCare or its licensors. Public-record facts remain public; our selection, arrangement and presentation of them is protected.
13Account security
If you create a provider account, keep your login private and tell us promptly about any unauthorized use. You are responsible for activity under your account.
14Links to other websites
We link to agencies, providers and other sites for your convenience. We don’t control them and aren’t responsible for their content or practices.
15Third-party products and services
If you use a product or service offered by someone else through the Site, that provider’s terms apply.
16Submissions
If you send us corrections, photos or other content, you confirm you have the right to share it and give us permission to use it to operate and improve the Site.
17Disclaimer
The Site and services are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including accuracy, fitness for a particular purpose and non-infringement.
18Limitation of liability
To the fullest extent the law allows, WeFoundCare will not be liable for indirect, incidental, special or consequential damages, or for any care decision or provider conduct. Our total liability for any claim is limited to $100.
19Indemnification
You agree to defend and hold WeFoundCare harmless from claims arising from your misuse of the Site or breach of these terms.
20Ending access
We may suspend or end access to the Site for anyone who breaks these terms. Sections that by their nature should survive will survive.
21Changes to the Site
We may change, add or remove features at any time.
22Early-access features
Some features may be labelled beta or preview. They may change or stop working, and are provided without any commitment.
23Governing law
These terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules.
24Arbitration and class action waiver
Except for small-claims matters and requests for injunctive relief about intellectual property, you and WeFoundCare agree to resolve disputes through binding individual arbitration. You and we each give up the right to a jury trial and to take part in a class action. You may opt out within 30 days of first accepting these terms by emailing legal@wefoundcare.com.
If this section is found unenforceable
If any part of this section can’t be enforced, the rest still applies, and claims that can’t be arbitrated will be heard in the courts of the state named in the governing law section.
25Copyright complaints
If you believe content on the Site infringes your copyright, send a notice to legal@wefoundcare.com with the details required by the Digital Millennium Copyright Act.
26General terms
These terms are the whole agreement about the Site. If any part is unenforceable, the rest remains in effect. Our not enforcing a term is not a waiver. You may not transfer these terms; we may. Contact: WeFoundCare, 222 2nd Avenue South, Suite 1700, Nashville, TN 37201.
